Terms governing use of the FitnessTest website and related services.
1. Agreement
These Terms of Service govern your use of the FitnessTest website and services relating to product evaluations, reports, and the FitnessTest Certified™ program. If you enter into a separate written agreement (quote, order, statement of work), that agreement prevails over these terms where they conflict.
2. Who we are

3. Services
FitnessTest provides independent evaluation of fitness equipment using documented methodology (including published standards such as EFEI-02001). Unless otherwise agreed, evaluation outcomes may be published and listed in a public registry so buyers can verify results.
4. Evaluation process and fees
Requests may be submitted by manufacturers, brand owners, and authorized distributors. Fees are quoted for your product category and scope. Work generally begins after contract formation and satisfaction of agreed preconditions (e.g. sample receipt, payment). Fees for work already performed may be non-refundable as set out in your order.
5. Certification, marks, and subscription
Use of FitnessTest Certified™ badges, marks, and related assets is subject to program rules, brand guidelines, and—where offered—an active subscription or other written entitlement for the relevant product. Meeting the evaluation threshold alone does not authorize mark use if commercial terms are not in place. The report documents the product as tested; material changes to the product may require re-evaluation.
6. Independence
Results are determined by objective protocols. Payment does not guarantee certification or any particular score.
7. Intellectual property and acceptable use
The website, methodology descriptions, reports, and marks are protected by intellectual property laws. You may not scrape, reverse engineer, or misrepresent affiliation with FitnessTest. Reports and extracts may be shared only as permitted by your agreement and usage guidelines.
8. Disclaimers and limitation of liability
Website content is provided for general information. To the fullest extent permitted by law, we exclude liability for indirect and consequential damages. For slight negligence we are liable only for breach of material obligations and limited to foreseeable, typical damage, except in cases of injury to life, body, or health or mandatory statutory liability.
9. Governing law and venue
These terms are governed by the laws of the Republic of Estonia, excluding conflict-of-law rules. Mandatory consumer protections of your country of residence remain unaffected if you are a consumer. For merchants, exclusive venue is Tallinn, Estonia (courts competent for Valeridium OÜ), where legally permissible.

11. Changes
We may update these terms; the revised version applies from the date posted unless we notify you otherwise for existing contracts.
