These Terms of Service govern your use of the FitnessTest website and evaluation services provided by FitnessTest.
1. Acceptance of Terms
By accessing and using the FitnessTest website and services, you accept and agree to be bound by these Terms of Service and our Privacy Policy. We reserve the right to modify these terms at any time; changes are effective upon posting.
2. Services Provided
FitnessTest provides independent evaluation and testing of fitness equipment, certification of products meeting our quality standards (60/100 minimum score), publication of evaluation results, certificate verification services, and information about testing methodology and standards.
3. Evaluation Process & Fees
Evaluation requests may be submitted by manufacturers, brand owners, authorized importers, and retailers with manufacturer authorization. Evaluation fees are determined based on product category and testing requirements. Fees are quoted in advance and must be paid before testing begins. Evaluation fees are non-refundable once testing has commenced.
4. Certification & Logo Usage
FitnessTest certifications are valid for 3 years from the date of issue. Upon certification, you are granted a non-exclusive license to display the FitnessTest certification mark in accordance with our brand guidelines, limited to the specific product model that received certification. Misrepresentation or misuse may result in immediate license revocation.
5. Independence & Objectivity
FitnessTest maintains strict independence protocols. Test results are determined solely by objective laboratory measurements and standardized evaluation criteria. Payment of evaluation fees does not guarantee certification or influence test outcomes.
6. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes is Munich, Germany, to the extent permitted by law.
